What is a 'no win, no fee agreement?
A conditional fee agreement, also known as 'no win, no fee' agreement, is a simple method of covering the legal costs involved in claiming accident or injury compensation. Under the terms of a 'no win, no fee' agreement, we will agree to take no payment until the end of the case. In the event of a win, our fees will be covered by the losing party, however you may be required to contribute to the legal costs and this will be discussed with you prior to starting your claim; if the case is lost, we take no fee so there is no cost to you.
What do I pay if I lose?
If you lose your case you will normally not be required to pay anything.
What do I pay if I win?
If you win your claim, we will recover our basic charges, our expenses and disbursements from the losing party. You will be required to pay our success fee together with the cost of any insurance premium if applicable.
What is a success fee?
The Success fee is the percentage of basic charges that we add to your bill if you win your claim for damages. There is a maximum limit on the amount of the success fee which we can recover from you, we will never recover more than 25% of your claim.
What is an Insurance Premium?
In order to ensure our clients are not required to pay any of the other parties costs if ordered to do so, we take out an 'after the event' (ATE) insurance policy on their behalf. An ATE Policy is specifically designed to protect clients where part or all of the claim is unsuccessful. The cost of the ATE insurance policy is, like the legal fees, deferred until the end of the case so there is no outlay to you. If the case is lost, no payment is required, as the premium is self insuring.
